1. ABOUT THIS WEBSITE
This website is operated by African Containers Hub Pty Ltd, trading as African Containers Hub (“African Containers Hub”, “ACH”, “we”, “us” or “our”).
African Containers Hub is a South African business involved in the sale, supply, modification, conversion, delivery and related provision of shipping-container products and container-based solutions.
Our website provides information and may facilitate enquiries, quotations, orders, electronic communications and, where available, electronic payment for products and services supplied by ACH.

- any quotation, order confirmation or other contractual document applicable to a particular transaction.
2. LEGAL IDENTITY
Legal entity: African Containers Hub Pty Ltd
Trading name: African Containers Hub
The legal entity identified above is the supplier and contracting party for products and services supplied by ACH unless a particular written agreement expressly identifies another contracting party.
ACH is not a marketplace, payment intermediary, lender, remittance provider, financial institution or payment aggregator.
Where a third-party payment provider is used, that provider processes the relevant payment transaction as a payment service provider. ACH remains responsible for the products and services that ACH itself supplies.
3. NATURE OF OUR BUSINESS
African Containers Hub supplies and/or arranges products and services including, where available:
- new shipping containers;
- used shipping containers;
- 20-foot containers;
- 40-foot containers;
- storage containers;

- container workspaces;
- container workshops;
- container shops and kiosks;
- café and food-service container units;
- ablution and facility units;
- modified containers;
- converted containers;
- custom container builds;
- project-specific container solutions;

- delivery, transportation, positioning, offloading and related logistics services where specifically quoted.
The exact products, specifications, availability, condition, configuration, pricing and delivery arrangements applicable to a transaction will be determined by the relevant product listing, quotation, order confirmation and/or written agreement.
4. WEBSITE INFORMATION
We endeavour to ensure that information published on this website is accurate, current and useful.
However, product availability, stock levels, specifications, photographs, dimensions, colours, finishes, configurations, delivery options and pricing may change.
Photographs may be illustrative and may not necessarily represent the exact unit ultimately supplied.
Where a product is subject to a customer-specific quotation, the quotation and subsequent written order confirmation will govern the commercial terms applicable to that transaction.
Nothing on this website constitutes a guarantee that a particular product, specification, configuration or delivery option will remain available.
5. PRODUCT AVAILABILITY
Products displayed on the website may be:
- available for immediate purchase;
- available subject to stock;
- available subject to supplier confirmation;
- available by quotation;
- subject to modification;
- subject to manufacturing or conversion time; or
- unavailable at the time an enquiry is made.
An online enquiry or request does not, by itself, guarantee that a particular container has been reserved for the customer.
Where stock or availability is material to a transaction, ACH will confirm availability before accepting the relevant order or payment where appropriate.
6. PRICING AND QUOTATIONS
Prices displayed on the website may not include every cost associated with a particular project.
Depending on the transaction, additional costs may include:
- delivery;
- transport;
- offloading;
- crane or specialised equipment;
- positioning;
- site-access requirements;
- modifications;
- installation;
- additional materials;
- custom fabrication;
- permits or third-party charges; or
- other project-specific requirements.
Where a delivery or project quotation is required, ACH will assess the relevant requirements and provide a customer-specific quotation.
A quotation may be subject to a stated validity period, stock availability and the assumptions expressly stated in that quotation.
7. ELECTRONIC COMMERCE
ACH conducts certain commercial activities electronically.
The Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) establishes information requirements for suppliers conducting electronic transactions, including disclosure of supplier identity, contact information, relevant product/service information, pricing, payment, delivery and return information.
Accordingly, customers should have access to our relevant:
- business identity;
- contact information;
- product and service descriptions;
- pricing information where applicable;
- payment information;
- delivery information;
- return and refund information; and
- privacy information.
These matters are addressed through this Legal Notice and the related policies published on our website.
8. ELECTRONIC COMMUNICATIONS
When you communicate with ACH electronically, including by email, website form, WhatsApp or another supported communication channel, the communication may constitute a data message for purposes of applicable South African electronic-commerce legislation.
We may retain electronic communications where reasonably necessary for:
- customer service;
- quotations;
- orders;
- payment administration;
- delivery;
- dispute resolution;
- legal compliance;
- record keeping; or
- legitimate business administration.
The use of electronic communications does not remove any statutory consumer or contractual rights.
9. ELECTRONIC RECORDS
Where applicable, ACH may maintain electronic records of:
- enquiries;
- quotations;
- orders;
- invoices;
- payment confirmations;
- delivery arrangements;
- customer communications;
- cancellations;
- refunds;
- complaints; and
- other transaction-related information.
Electronic records may be used to establish the history and terms of a transaction.
Where applicable law requires a particular record to be supplied to a customer, ACH will provide the record in accordance with that law.
10. ELECTRONIC SIGNATURES AND ACCEPTANCE
Where electronic acceptance, confirmation or signature is used, ACH may rely on the applicable electronic record as evidence of the relevant transaction or acceptance to the extent permitted by law.
No provision of this Legal Notice is intended to exclude statutory requirements concerning electronic signatures, authentication or consumer consent.
11. PAYMENT PROCESSING
ACH may make payment facilities available through third-party payment providers.
Where Paystack or another payment provider is used:
- the payment provider may process payment information;
- the provider’s own terms and privacy policies may apply to payment processing;
- ACH remains responsible for the products or services supplied by ACH;
- payment confirmation may be required before fulfilment; and
- refunds may be processed through the relevant payment mechanism.
ACH does not represent itself as the payment provider merely because a payment provider’s service is integrated into the purchasing process.
12. PAYMENT SECURITY
ACH will not ordinarily request confidential banking credentials through email, WhatsApp or ordinary customer-service communications.
You should never provide ACH with:
- an online-banking password;
- banking PIN;
- one-time banking authentication code;
- card PIN; or
- other confidential authentication credentials.
If you receive a suspicious request for payment information purporting to come from ACH, verify the request using our published contact details before making payment.
13. DELIVERY AND LOGISTICS
Delivery is a separate logistical component of many container transactions.
Delivery arrangements may depend on:
- destination;
- distance;
- container size;
- quantity;
- vehicle requirements;
- road conditions;
- access to the site;
- entrance dimensions;
- overhead obstructions;
- ground conditions;
- unloading requirements;
- positioning requirements;
- crane or specialised equipment;
- local restrictions; and
- other site-specific circumstances.
The customer’s delivery obligations and ACH’s delivery obligations are further described in the Shipping, Delivery & Logistics Policy.
14. SITE ACCESS AND POSITIONING
A customer is responsible for providing accurate information regarding the delivery site and for ensuring that the site is reasonably accessible for the agreed delivery method.
Where applicable, the customer must disclose relevant hazards or restrictions known to them, including:
- narrow entrances;
- low overhead clearance;
- restricted roads;
- steep access;
- unstable ground;
- underground infrastructure;
- overhead power lines;
- restricted turning areas; or
- other conditions that may affect safe delivery.
Additional costs or a revised delivery arrangement may apply where actual site conditions materially differ from the information supplied.
15. CUSTOM AND MODIFIED PRODUCTS
Custom-built, modified or converted containers may be produced according to customer specifications.
Because such products may be made or modified specifically for a customer:
- specifications should be reviewed carefully before approval;
- customer measurements and requirements must be accurate;
- changes after production or fabrication has commenced may result in additional costs or delays; and
- cancellation and return rights may be affected by the nature of the custom product and applicable law.
Nothing in this Notice removes any mandatory statutory rights that apply to the particular transaction.
16. USED CONTAINERS
Used containers are previously utilised products and may display ordinary characteristics associated with prior use.
Depending on the particular unit, this may include:
- cosmetic wear;
- dents;
- scratches;
- surface corrosion;
- previous repairs;
- patches;
- markings;
- variations in paint or finish; and
- other evidence of prior use.
The condition of a particular used container should be assessed against the description, photographs, quotation or inspection information supplied for that unit.
Where a specific condition has been contractually represented, that representation will apply subject to the applicable agreement and statutory rights.
17. WEBSITE CONTENT AND INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website, including:
- text;
- branding;
- logos;
- graphics;
- photographs;
- designs;
- page layouts;
- product descriptions;
- documents;
- software;
- original illustrations; and
- other materials
is owned by ACH or used under an appropriate licence or other lawful basis.
You may access and use website content for lawful personal or business purposes connected with considering or purchasing ACH products and services.
You may not reproduce, commercially exploit, republish, modify, distribute or otherwise use ACH-owned material without appropriate permission, except where permitted by law.
18. THIRD-PARTY MATERIAL
Some website functionality, payment services, links, integrations or content may be supplied by third parties.
Third-party services operate under their own terms, policies and technical controls.
ACH does not assume responsibility for independent third-party services merely because they are accessible through or integrated with the website.
Where a third party processes personal information, the ACH Privacy Policy and the third party’s applicable privacy documentation should be considered together.
19. EXTERNAL LINKS
Our website may contain links to external websites.
Such links may be provided for convenience or to provide access to relevant third-party information or services.
ACH does not necessarily endorse or control the content, availability, security or privacy practices of external websites.
You access third-party websites at your own discretion and subject to their applicable terms.
20. WEBSITE AVAILABILITY
We endeavour to maintain a reliable website, but electronic services cannot be guaranteed to remain continuously available.
The website may occasionally be unavailable because of:
- maintenance;
- upgrades;
- hosting problems;
- network failures;
- security measures;
- third-party service interruptions;
- technical errors;
- force majeure events; or
- circumstances beyond ACH’s reasonable control.
Nothing in this clause limits rights that cannot lawfully be limited.
21. CYBERSECURITY
Users must not:
- attempt to gain unauthorised access to the website;
- interfere with website operation;
- introduce malicious software;
- attempt to circumvent security controls;
- scrape or harvest information unlawfully;
- impersonate ACH or its personnel; or
- use the website for fraudulent or unlawful activity.
ACH may suspend or restrict access where reasonably necessary to protect its systems, customers or business.
22. PERSONAL INFORMATION
Personal information submitted through the website or during a transaction is processed in accordance with ACH’s Privacy Policy.
The Privacy Policy explains:
- information collected;
- purposes of processing;
- payment processing;
- delivery-related information;
- third-party service providers;
- marketing;
- security;
- retention;
- data-subject rights; and
- complaint mechanisms.
The Protection of Personal Information Act 4 of 2013 establishes minimum requirements for lawful processing of personal information by public and private bodies. The Information Regulator is the statutory regulator responsible for POPIA.
23. CONSUMER RIGHTS
Nothing in this Legal Notice is intended to remove, restrict or waive any consumer right that cannot lawfully be excluded.
The Consumer Protection Act requires consumer-facing notices and information to be understandable and, where no prescribed form exists, presented in plain language.
Accordingly, ACH’s policies and transaction documents should be read together and interpreted consistently with applicable South African consumer law.
24. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, ACH will not be responsible for loss or damage arising solely from:
- interruption of website availability;
- circumstances outside ACH’s reasonable control;
- inaccurate information supplied by a customer;
- unsafe or inaccessible delivery conditions caused by the customer;
- third-party service failures; or
- unauthorised access resulting from circumstances that ACH could not reasonably prevent.
However, nothing in this Legal Notice excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, this Notice does not exclude statutory consumer protections, liability that cannot legally be excluded, or liability arising from unlawful conduct.
25. NO UNLAWFUL DISCLAIMER
Nothing contained on this website should be interpreted as:
- a waiver of statutory consumer rights;
- a waiver of POPIA rights;
- a waiver of rights under ECTA;
- an attempt to contract out of mandatory legislation;
- an exclusion of liability that South African law prohibits from being excluded; or
- a restriction on a consumer’s right to approach a competent regulator or court.
Where mandatory law provides greater protection than this Notice, the mandatory law prevails.
26. ACCURACY OF CUSTOMER INFORMATION
Customers are responsible for ensuring that information supplied to ACH is accurate and complete.
This is particularly important for:
- delivery addresses;
- contact details;
- site information;
- container dimensions;
- modification specifications;
- quantities;
- billing information; and
- access requirements.
Incorrect information may cause delays, additional costs or an inability to perform a delivery or project as originally quoted.
27. FRAUD AND IMPERSONATION
ACH will not knowingly authorise unauthorised persons to collect payment on its behalf.
Customers should verify unusual payment requests, especially requests involving:
- changes to banking details;
- urgent payments;
- unusual payment channels;
- requests for confidential credentials; or
- payment to an account that differs from the approved transaction documentation.
If in doubt, contact:

29. REGULATORY COMPLAINTS
Nothing prevents a consumer from exercising a statutory right to approach an applicable regulator or other competent authority.
For personal-information matters, the Information Regulator has jurisdiction throughout South Africa and oversees compliance with POPIA and PAIA.
For consumer matters, applicable consumer-protection mechanisms remain available in accordance with South African law.
30. GOVERNING LAW
This Legal Notice and the use of the website are governed by the laws of the Republic of South Africa.
Subject to any mandatory jurisdictional rights available to consumers under applicable law, South African law governs the interpretation of this Notice and the relationship between ACH and users of the website.
31. SEVERABILITY
If any provision of this Legal Notice is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the extent necessary, and the remaining provisions will continue to operate to the fullest extent permitted by law.
32. NO WAIVER
A failure by ACH to enforce a provision of this Legal Notice immediately does not constitute a permanent waiver of that provision or of any other right.
33. CHANGES TO THIS LEGAL NOTICE
ACH may amend this Legal Notice where reasonably necessary because of:
- changes to the business;
- changes to the website;
- changes to products or services;
- changes in technology;
- changes in payment or logistics providers;
